Unfair Billing

I had an accident 10/5/01 (back Injury) as a result, I incurred several medical bills amounting to several thousand dollars, No coverage. Woked out with all, except Hospital to pay monthly. I have been paying hospital regularly on a monthly basis for 4 months. They have turned over to a collection agency, because I can't pay entire balance in full. I can not pay full amount & my question is, can any action be taken against me as long as I am paying regularly on this bill?

A creditor, like the hospital in your case, is not required to accept less than payment in full. The hospital most likely has a policy to turn over its accounts receivable to a collection agency if the account is not paid in full within a certain period of time. They do this for cost reasons.

Most likely you can continue to make the same payments if you negotiate with the collection agency. Let them know what you can do and if it is reasonable they should allow you to continue. If you make your payments timely there should not be a problem.

They are not required to do this, however, most collection agencies would rather you pay voluntarily a reasonable amount than try to execute on a judgment. I hope this helps you.
