There is no technical reason that requires the case to be thrown out. The reason for the firing of the officer may be a factor in the cross examination of the former officer if he should take the witness stand and testify against you. If the officer does not take the stand due to his rights under the 5th Amendment to the United States Constitution, and if the state has no other witnesses in the case against you, you may be in a position to have the case dismissed for failure to prosecute.
