Legal Question in Family Law in Tennessee

child custody

I have tried to get custody of my 16 soon to be 17 (in July) son back (his wishes and mine) after his father telling him that when he moved in with him that if he did not like it there , TN (rural area) or did not work out for whatever reason that he would allow him to move back here with his mother. I tried taking him back to court here in St. Louis County were divorce and other modifications have taken place but the judge dismissed it called and heard and sustained as to inconvenient forum over object of Peteitioner's counsel. (What that means I do not know, my attorney will not return my phone calls now)

If my son comes here for visititation this summer and turns 17 does he have the right to rufuse to ruturn home with his father even though his father has physical custody?
