Child support and visitation rights

i would like to know if i take my childs father to court for child support and we have never been marreid do i have to give him visitation and also have to let him be around his wife?he has never paid child support and my son is now 4.he only gets him on weekends when his wife is not in a bad mood.as of right now he has not seen him in about 2 months.i feel like he should help me financially if he is not going to see him like he should but i don't want him to be around his wife anymore,so i would like to know what rights i have? thank you so much

In Tennessee the visitation issue and child support issue are seperate. Although the visitation issue has a direct barring on how much child support one could be ordered to pay, it is handled in two different petitions and in many jurisdictions is handled in two different courts. As it relates to child support, a person's support could go up is he/she doesn't at least 54 days a year. In regards to visitation a person could be found in contempt for not following the court's order. If you are suggesting that you would like the visitation stopped or decreased because of your relationship with the dad's wife, the court's would be hard pressed to modify the visitation based on that alone. However, if there were other factors the court would at least take all the circumstances into consideration.
