Legal Question in Family Law in Tennessee

Failure to comply with court order

I am divorced and I have a court order that allows me to speak to my children on the phone Monday thru Thursday nights. My ex will not comply with this order. I am not allowed to speak to them now because they are grounded for being untruthful to their mother. What can I do to speak to my children?

Re: Failure to comply with court order

The statute provides for you to have reasonable, uncensored telephone contact with your children. Your ex-spouse may not use the deprivation of your time as a punishment for another offense. You have the grounds to file a petition for contempt against the parent. You will need an attorney to file this for you in the court from where the original order issued.

File for contempt. The Tennessee Parental Rights Act, Tenn. Code Ann. sec. 36-6-101 addresses these type of issues. For more info, see www.gsmithlawfirm.com
