Legal Question in Family Law in Tennessee

inner-family adoption

my 14yr old neice is in foster care and is expecting a child and my wife and i would like to adopt it.she lives in tennessee and we live in oklahoma.she is still unsure of what she wants to do.If she agrees to let us adopt it,how would this work since shes in foster care? If she does choose to keep the child would foster care let her keep it with her? Also would there be and financial assistance to a family member willing to adopt the child? Thank you very much.

Re: inner-family adoption

In Tennessee, whether the girl is allowed to keep the child depends on whether she is able to care for the child and provide a home for it. If she relies on foster care, and there are no foster parents who would have it, then she might not be able to keep the child and the child would also go into foster care, with the mother allowed to see the child for a total of four hours a month, (2 visits of 2 hours each), and with the mother required to arrange for transportation to visit the child.

The only financial assistance I know of that you might get is for the adoption itself, for which you would be entitled to a tax credit of up to $5,000 to pay for all of the costs associated with the adoption.

Once you adopt the child, the child is yours. Period. Legally the same as if the child was naturally born, and I assume that means there would be no special financial assistance.
