Legal Question in Family Law in Tennessee

stepparent adopting my son

I have a 4 and a half month old son. There is no father named on the birth certificate. I have not heard from his biological father since I was 14 weeks pregnant. My son has the last name I had legally when he was born. I have remarried and my new husband wants to adopt him. Is there any problem with this. No paternity tests are pending and I recieve no child support for this child. The father has hired an attorney to try to see him and says he wants to be in his life but there is not any legal action at this point and I do not want him to be in his life. I have not heard from his attorney in 2 weeks.

Re: stepparent adopting my son

The adoption statute does allow for a n adoption by a stepparent. However, now that the father is seeking visitation, the granting of such petition may be difficult. I would also be willing to speak with you about, the visitation, child support and the issue of paternity. 423 266-4855
