Legal Question in Family Law in Tennessee

visitation wrights of spouse of non custidoal parent

my daughter is divorced and has two children and in the original marriage diissolution it is agreed that her x husband does not leave children with anyone else while in his visitation, hes works 24 hr shifts

when he works, its always been that he doesent get children when he works, now he has remarried he wants

his wife to have the children on his days that he works that hes suppose to have visitation, her attorney

says that she must go along with this that the judge would grant this to him anyway,we feel that this would be like giving anyone off the street visitation to the children, the visitation should be with the father, but this is giving his wife visitation wrights

please help!! what is the law on this???

There is no hard and fast rule addressing the issue you raise, some judges will require that visitation be WITH the parent, but others will not and would allow the father to leave the children with his wife while he is at work, even when at work for the entire period of visitation.
