Legal Question in Civil Litigation in Tennessee

Neighbor acusing Pet Dog of killing his cow.

Hi,

I am facing going to court next month, my neighbor called telling me my dog killed his cow and I owed him $500.00. I ask if he saw my dog do it and he said no but he saw it eating it.

My dog was predominately white with a few black spots on her (there was no sign of blood from the deceased cow anywhere on my dog) and was in heat, that was the reason she was in the field in the first place trying to get away from the dog that was trying to breed her. She was not in the field where the

cow was deceased she was in

the one between us. I need

to know what to say to the judge to defend my dog which is now dead. She was shot by one of the neighbors friends months after this thing came up. I would stake my life that my dog did not and would not kill the cow. She was not hungry as they had plenty of food. I buy it in 50lb sacks. She was doing what I call the mating dance with the other dog which she did the same thing the past time she was in heat.

I would be very grateful for any help you can give me as I am on a fixed income and cannot afford to pay for his suppositions. Thank you Alisha

Perhaps you may want to focus on the size of your dog and whether or not it could actually kill a cow. Otherwise, you would seem to be in a very difficult situation. The other side will have to prove that your dog killed the cow, but it will not have to be proof beyond a reasonable doubt.
