Legal Question in Intellectual Property in Tennessee

Copyright Infringement

I am the founder of an online Star Wars costuming website. I would like to produce t-shirts for my members to wear. The t-shirts would have our ''club'' logo that includes the words The Jedi Assembly and a picture of a lightsaber. Would this violate copyright rules with Lucasfilm Licensing? Is using the words Jedi and pics of Lightsabers against copyright laws?

Re: Copyright Infringement

The words "Jedi Assembly" would be copyright infringement. A picture of the light saber would be trademark infringement and/or "passing off" someone else's product as yours. You need to contact Lucas Entertainment and obtain appropriate licenses before marketing these products.

They could also assert trademark and unfair competition claims. You don't want to fool with someone like Lucasfilm. They have "The IP Force" and they will find you and come down on you like Darth Vader leading a band of Storm Troopers. Do like Amy says and pursue a licensing deal.

Re: Copyright Infringement

Prior two replies are correct in that (i) you would be infringing a variety of rights, (ii) they WILL come and hunt you down. However, the merchandising rights for a property like this are probably already licensed out on an exclusive basis (meaning, they likely cannot grant you a license because some other company already has exclusive rights to sell T-shirts bearing the Star Wars property elements). Best wishes,

LDWG
