salary- oral contract?

I am a cook at local restaurant. I have been there 2 years,with no written contract,but with oral agreement that I be paid for 40 hours whether I work over 40 or under 40.

Last week ,my boss askes me if I thought she could run the restaurant without me, and i answered no. She suspended me for a week without pay for being honest.Today i return to work, and she tells me i only work 3 nights a week. Am i still intitled to my 40 hour pay? , and if not, am I intitled to back overtime pay for the last 2 years?
