Legal Question in Personal Injury in Tennessee

what am i entitled to

daughter and i were hit from behind while stopped at a red light on may 3rd 2003, tring to settle with insurance company. we continue to have headaches. neuroligist calles it post tramatic migranes, insurance company is only wanted to pay for medical bills and 800.00 for me and 500.00 for my daughter. i do not think this is fair

Insurance companies use different factors to evaluate the value of cases. These include the type of impact, the amount of medical expenses and the resulting damages. Every case is different and must be evaluated on the facts.

You should remember that you have to pay back your health insurance for any of the bills they have paid.

You have one year to file suit. Don't let that deadline pass or your claim will be over.

You are entitled to more. It sounds like the other side is a fault. You are entitled to money for your pain and suffering. The insurance company will probably not offer that money to you unless you hire an attorney to demand it.

Damages may be considered in the following formats:

Pain and Suffering- Past and Future:

Permanent Impairment;

Loss of ability to enjoy life - Past and Future;

Medical Care - Past and Future;

Loss of Earning Capacity - Past and Future.

As mentioned, time is a factor to consider. Tennessee has a one year statute for adults.

If you and your daughter have both been to the nerologist who has diagnosed migranes due to the accident, you would be well advised to contact an attorney for a full discussion of your case. Please bear in mind that the Statute of Limitations to file a lawsuit for personal injuries in Tennessee is one year.
