infered to be gay

me and a coworker both in management have been sexually harrassed over a long period of time by text messages stuff on the office boards and even to the point of drawings being passed aroundafter i got hurt at work we talk on the phone outside of work and thats it neither of us is gay the company acted like they investigated the first time we mentioned it like 2 years ago but didnt really do anything last time with the drawing they just said it upset them and that was it what do you think

In order to state a claim for sexual harassment, the harassment must be either severe or pervasive and it must be sufficient to interfere with your day-to-day work. Additionally, it must be based upon your gender. That is, you must be harassed because you are male or because you are female. If that is the case, then you probably have a legitimate claim of sexual harassment.

The next step in the analysis is to determine whether or not your company has a safe harbor to escape liability. The safe harbor exists when the company has a published anti-harassment policy which you unreasonably fail to take advantage of.
