Legal Question in Sexual Harassment in Tennessee

workplace clothing

Can your employer demand that you purchase a particular type of ''underclothing'' that is particular to the female race? I work in a hospital environment and am being required to purchase bras from a particular store that value about $50.00 each in order to work in a certain area of the hospital. There are other areas available for my employment - that is not the issue. My question is can the department require my purchasing a particular type of underware - namely non underwire bras? The reasoning has to do with setting off a feromagnetic detector. The males in the department need only put on surgical scrubs if the zippers in the pants set off the detector.

Re: workplace clothing

If the requirement is a legitimate requirement for the position, then it is a legitimate demand. I am not aware of any requirement in the law that your employer give you the choice of where to procure the particular articles of clothing. The only requirement would be that the employer not impose different requirements on males as opposed to females.
