Legal Question in Wills and Trusts in Tennessee

My Mother recently passed away she left no will or legal documents for me or my Sister to draw her savings out of her bank, my Sister is on her checking account. And the Life Insurance Co stated she had no beneficary on her policy. My Son owns my Father's half of the estate, but my Mom wanted me and my Sister to have her part. What should I do?

You will most likely need to petition the court to probate your mother's estate. Depending on the facts, you may have a right in a share in the life insurance policy and perhaps the checking account (depending on how it was set up). Please let me know if you have any further questions.

If the checking account is joint, your sister owns the checking accout. If there is no beneficiary on the life insurance policy, the estate is the beneficiary and the insurance company will require your mother's estate to be probated to show the beneficiaries (heirs) of her estate.
