Legal Question in Wills and Trusts in Tennessee

Will held in probate

My father's will is being held up in probate court. The reason given was that my mother's power of attorney was never ''recorded with a court''. What does that mean? This power of attorney was used at a state bank to make transactions; why wouldn't it be accepted at probate court?

(As a side note; we are challenging the validity of my mother's signature on this power of attorney).

Re: Will held in probate

Don't know! But it could be that the court is attempting to establish what is actually in or should be in the estate and if transfers made transferring assets from the estate prior to death under the power of attorney are voidable. If you haven't hired an attorney to assist in safeguarding your portion of the estate, I can help, if it's in Tennessee. 423 266-4855
