how to file in small claims court

My company allowed the sales force to hire appointment setters and they reimbursed them as a 1099 contractor 3% of the sales they made for us. I hired a small firm out of Oregon called All About Marketing who had me prepay for the appointments and agreed to reimburse me once they got paid by my company. They were then charged back by another client from my company who used them for $1100 that was on a credit card because she was unhappy with their services and now she claims she doesn't have the money in her accounts to pay me. The company has paid her over $2,000 and I have paid her $1480.00 and she has given me 29 qualified appts at $60 each. I am getting nowhere with her and she says until she gets her money back from the credit card company for the chargeback that she can't pay me. I think she is about to go out of business and I wonder if I have a chance to get my money back and how to go about filing a claim. I am in Texas and she is in Oregon.

Thanks for any advice. she has mentioned a loan from her son to pay me back but then I can't get her to confirm or committ to anything! Maybe a strong letter from an attorney would do the trick.
