Legal Question in Business Law in Texas

Testimonials

I am trying to find the rights to use testimonals (medical in nature, refering to back pain relief) in our advertising media (Newspaper, Radio and Television)for all US States. One of our clients told us that in Texas we cannot use testimonials, another told us this was resended.

All of our testimonials are documented and are used in their own words.

We are trying to find the law as it pertains to testimonials for ALL States. Can you help?

Re: Testimonials

If you want a lawyer to research whether you can use testimonials in advertising in all 50 states, you will likely have to meet with one in person, retain the law firm and pay a retainer to have the lawyer commence working on your behalf.

Re: Testimonials

Specifically, what is it you are trying to advertise? What are the testimonials used for? What do you mean that the testimonials are documented? Do you have releases and authorizations from those who gave the testimony? Are there certain states that you would like to start advertising in and then branch out, state by state? If you would like to discsuss your business plan more fully, then contact our firm at (305) 769-3000.
