Legal Question in Construction Law in Texas

G.C.

I am a G.C., and I have under bid a hotel project by 150,000 dollars just in material and labor, no profit. I am toward the end of job, but with no funds to finish. I signed a lump-sum contract 8 months ago. A lot of items have increades in labor and/or material, plus there were some items that I overlooked to begin with. What are my options? I want to finish the job, but I can't pay for it.

Re: G.C.

Your contract should have provided for changes in the price of materials/labor. If you don't have any of this covered, then you would have to sue and ask a court to make the owner pay for those unanticipated costs. The ones you overlooked would be hard to make up. Another option is trying to negotiate with the owner, but be careful what you say to them now because it can come back to bite you later.
