Legal Question in Consumer Law in Texas

Car purchase recision

I sold a vehicle to a gentleman on December 27, 2004 and the guy called back the next day and said he changed his mind and wanted his money back. When he purchaed the truck, I informed him that I would send him the title when I paid the truck off, which I did the same day. He claims the truck does not get good gas mileage. Since I've already paid the truck off, do I have to give him his money back according to this 3-day rule I've heard about?

Thanks,

Confused

Re: Car purchase recision

The short answer is "NO".

There isn't any 3-day rule except for home solicitation sales, and timeshare sales where the property isn't shown.

When a second-hand vehicle is sold, it is sold as is, where is, with all flaws except for written warranties. You couldn't promise any particular fuel consumption because that's a function of the load being carried, road and weather conditions, and the size of the driver's foot.
