Legal Question in Consumer Law in Texas

Magazine Subscription

Telemarketers called me and offered a magazine subscription. I thought it was a one time fee of $39.95. It was actually a $39.95 a month. I called to cancel and they said okay but, to pay what I owed which was about $80.00. So, I paid and received a bill of $39.95 for Jan. 1, 2007. I called and told them ''X'' told me to pay and then they can cancel. A rep. told me I cannot cancel because of a verbal agreement...I asked them to replay my verbal agreement and they said they would call me back and never did. Now, they tell me in order to cancel I have to pay 6 months in advance and it will cancel in June 2007. I just said okay and gave them my info. over the phone. Why can't I just cancel. The co. is Mountain Area Communications in Eden Prarie,MN. What should I do?

Re: Magazine Subscription

It sounds like credit card payment...and if from your bank account...why pay?..if credit card...you may cancel that card..

This is a scam which is used for many companies ...get payments then get more...

I agree with Mr. McLeaish, and want to add that I was unaware that this was a regular scam until I joined this attorney board. I have read questions EXACTLY like yours several times. In addition to notifying the bank to stop payments, notify the Attorney General's office -- I doubt if they made an error, this is an ongoing fraud to scare people into paying for nothing.
