Walmart oil change blew up my engine

Afteer receiving an oil change from Walmart they used the wrong oil filter and all the oil drained out my engine which only had 11K miles on it and was less than a year old. After a month, Walmart deferred it to Fram saying it was a faulty oil filter. So shorten this up... it's been 3 months. I've racked up $4K of my own money for a rental car. The insurance company for Honeywell (Fram) is rude, has never contacted me regarding my claim and I call them every day. It took them another month to have it appraised. I have it all documented. The cost of a new engine is $13K...the blue book value of the minivan is only $14,910. Shouldn't they just pay me for the blue book? Now they are arguing over rental charges. What are my options here? Is a lawsuit too drawn out? Thank you.

Get a lawyer!

Otherwise the insurance company will string you out until limitations bars any lawsuit, then they'll finish screwing you.

Are you kidding? Your car is worth $14,000, your rental is $4,000, and you don't have a lawyer?

Do yourself a huge favor, and hire a lawyer tomorrow. You may have to outlay some money for costs and a retainer, but these guys are going to drag this out until you are desperate, and you have nowhere to go, except to accept their rock-bottom offer. There might be a better alternative available to you, but there is no way to know unless you have an attorney on your behalf.
