Legal Question in Credit and Debt Law in Texas

debt collection question

Ok, my husband had a credit card account in 1993 that went bad. The debt collection agency are now contacting us about paying it. Well, last night they called wanting me to authorize a payment out of my husbands checkign account (my name is no where on that account). They got mad and rude with me when I said I had no authority to authorize any kind of payment nor was I about to without my husbands' knowledge or ok. I was not born yesterday and know that is illegal anyhow. Well, they got mad and asked when my husband would be home and got even ruder when I said I didn't know because he is a coach and had to stay late. Well, my question is....what can we do about it and what are the laws about this kind of thing. We are tired of the harrassment.

Re: debt collection question

Write to them, certified mail, return receipt requested, telling them that (1) the statute of limitations has run on the debt, and (2) all future contacts are to be in writing.

If that doesn't take care of the problem, contact an attorney that's familiar with the Fair Debt Collection Practices Act.
