disabled with credit issues

I have credit card debt I am unable to pay.At the time the debts were incurred,I not only had my disabled widows benefits but additional income from an investment account. That acct. crashed leaving me with debts and approx. 60% less income.I am recieving calls and notices about these debts,some not very nice.Do I have any legal rights?Can I tell these people to leave me alone?(I am also over 55yrs).I tried to work with a comsumer debt co. but had to cancel because of medicare Part D,my drug costs have guadrubled and I could no longer afford it. I hate not paying these bills, I know my credit is screwed but I simply cannot pay. I have to borrow money pretty much every month from one family member or another just to get by. Do I have any recourse?

You can file for bankruptcy, but if you have no real assets to protect, there is no point in incurring additional expense.

I would suggest that you write a letter to each creditor and collection agency. Send it certified and keep a copy. Tell each one that your circumstance have dramatically changed since the time the debt was incurred. Tell each one that you are a disabled widow, with limited income. That your income does not cover your living expenses and that you are not able to pay the debt. Tell each one that any future contact must be in writing, and do not call you any more.

If you can manage to change your telephone number, and have it unpublished, do so.

The creditors may sue you, but if you have no assets to protect, then there are no assets for the creditor to execute against. A judgment is valid for 10 years, and renewable for another 10 years.

As you say your credit is already shot.
