Legal Question in Credit and Debt Law in Texas

Judement Lien Placed Against Joint Business Bank Account

I am in partnership with an individual that has a judgement for non child support payment and the District Attorney placed a judgement against our joint company bank account without notification. Aproximately a month ago we canceled our partnership verbally and did not file anything with the courts. What action can I take next to get the lien released if I cannot get in touch with my former business partner.

Re: Judement Lien Placed Against Joint Business Bank Account

Insofar as the world is concerned, you and your deadbeat are still in partnership. You'll have to change the assumed name certificate that shows the both of you as partners. It'd also help (when you have the opportunity) to put the account wholly in your name.

Speak with the DA and see if an affidavit might be sufficient.

The question is how was the partnership divvied up when you parted company? When a partnership is dissolved, the assets go to paying off the liabilities, and what's left is divided among the partners. What is his portion of the account?
