Legal Question in Criminal Law in Texas

Assault while on felony probation

When charged with class A mistemeaner assault while on felony probation do you appear before a mistemeaner judge or felony judge? In either case if a plea bargain is reached between the defendant and the D.A.,can the judge take your plea of guilt for accepting the plea bargain and in turn , turn down the plea bargain and use the plea of guilt to prosecute you to the full extent of the law?

Re: Assault while on felony probation

If a person assaults someone else while on felony probation, the assault conviction can be used as evidence of violation of the condition of felony probation and a motion to revoke probation may be filed. So, one could face a misdemeanor judge on the assault and then face the felony court.
