Drug Possession
Daughter was picked up in August, with possesion of crack cocaine and her car was impounded, also. She goes to court for car this week and is representing herself. Then after that she will appear before the judge in the case of the felony possession,to see if can go ahead with the arraignment, does she really need to be represented by an attorney.
Re: Drug Possession
Of course she does. This question supplies no information regarding her prior record, the deal offered by the state, or the circumstances of her arrest. In any event, however, she at a real risk of losing her car, going to prison, and having a large fine to pay.
Re: Drug Possession
Absolutely, she should hire an attorney. Being charged with a felony is very serious and carries severe penalties if she is convicted.
Re: Drug Possession
Absolutely she needs an attorney. There are too many potential pitfalls in self-representation. A conviction can negatively impact her for the rest of her life. An attorney can review the file to see if there are any problems that could get the case dismissed or if there aren't the attorney can negotiate the best possible terms for a probation (deferred adjudication). There are also potential driver's license suspension issues to consider. You should both meet with a lawyer before that court date if possible.
