minor consumption of alcohol

Almost 2 years ago, my sons (then 17 & 19)got tickets for minor consuming alcohol. The entered a not guilty plea. At pre-trial in Aug 2004, we asked for the discovery including a report/statement from the officer who issued the citation. We have never received the discovery nor have they been called back to court. I have made numerous phone calls to the court requesting info and asking for updates on case. They tell me still pending and they have no further infomation but insist we will be notified. How long can this go on? Do they not have to abide by any kind of time frame or statute of limitations? Could I simply have my sons send a letter requesting this matter be settled or closed?? What are the implications now that the oldest son is 21? I appreciate any thoughts on this.

Confirm that the court record reflects that both boys appeared when ordered. Confirm that any continuance was not attributed to them. Take that documentation to an attorney in your area and ask that he file a Motion to Dismiss, followed by an expunction. Moreover, if they posted cash bonds at the time of arrest, that will be refunded. The attorney fees should be reasonable, and well worth the expense, to get this arrest off of their records. TCL
