Re: non disclosure

Good question.

My understanding is that when the law first passed, there was confusion over whether it was treated as a new lawsuit, or attendant on the old charge.

As a result, every county was doing it a little differently.

Then an AG opinion in 2005 said it had to be attached to the old charge and could cost only $28.00 total in filing fees.

Then some counties got included in a law (?HB 2345) giving them permission to charge more.

I honestly don't know how it finally played out, and if some counties are still charging different filing fees. Last time I checked, Collin County charged $28.00 and Dallas County charged $210.00.
