Polygraph and Sex offenders
What happens when a person on probation for sexual assault (he was 19 and it was a consensual relationship with his girlfriend of ten months who was 14) fails a polygraph? He was given deferred adjudication and has been on probation for over three years and done well, completed the required counseling, community service, etc. He is scared to death now because he has to take the polygraph again in one month and has been told if he fails again he will probably go to prison. Is that true?
Re: Polygraph and Sex offenders
Polygraph for WHAT? You already plead guilty or no contest. That issue of guilt is moot. Is this a new accusation? Is routine polygraph a condition of probation? Regarding current behaviors? Do you have a copy of the report?
You need to find a lawyer immediately. Keep making calls until you find one that you can afford, and practices criminal defense in your county.
