Public Intoxication while parked on side of road

My son worked all day, went to have a few drinks and drove home, on the way he felt he was very sleepy. He pulled to the side of the road and fell asleep. The vehicle was on a Farm to Market Road and was not obstructing traffic, etc. an office, knocked at his window woke him up, asked him to step out of the car and handcuffed him. He never told him why he was being arrested. He was taken to jail and later learned that he was arrested for public intoxication. No breath, urine, or blood tests were given or requested. When he saw the judge he plead not guilty and the judge let him go on PR. ($500 bail)...What law did he break?

Well according to the office he was arrested for public intoxication. It seems to me you have two choices: 1. fight the charge (i.e., go to trial) , 2. enter a plea subject to some agreement reached with the D.A. office.
