Legal Question in Criminal Law in Texas

Robbery

My son was caught shoplifting for a department store, he dropped the merchandise and ran. He shoved someone tying to get away and ran, so instead of a misdemeanor he has been charged with a felony Robbery charge. What are the chances of getting it down-graded to a misdemeanor with a public defendant?

Re: Robbery

There is no way to predict the chances of getting the charge reduced. There are too many unknown factors. Age, priors, whether the person was hurt, the amount of merchandise being stolen, their proof, etc are all factors that weigh in, as well as the prosecutor, the county and the judge. Your son's attorney is also a factor. If you can retain an attorney for him (many will work with you on a payment plan) his chances improve, since public defenders usually carry a huge caseload, which prevents any real individual attention.
