Legal Question in Criminal Law in Texas

Sealing , Expunging or Destruction of Juvenile Record

Upon successfully completing Deferred Prosecution, I would like to have my child's record sealed, expunged or destroyed. Is this a difficult process and what is involved? Will I need to retain an attorney to accomplish this mission?

Re: Sealing , Expunging or Destruction of Juvenile Record

In my opinion you will need to hire an attorney to seal your child's record. However, there is a time frame before you are able to seal the record. A Deferred Adjudication cannot be sealed until five years after it is completed for a misdemeanor or ten years if it is a felony. By the way, the record cannot be expunged from your child's record it can only be sealed from third parties, such as apartment complexs, employers, etc. The process consists of filing a Petition with the Clerk, and going before the Court with a hearing.
