Legal Question in Criminal Law in Texas

Spousal Abuse (emotional)

I live in NY and my ex-girlfriend lives in TX. I believe I have enough evidence to prove that the levels of abuse I have taken are criminal. My question is: how do I go about taking the first steps in trying to charge her with abuse? I know I would have to relocate to TX for any court proceedings, but do I have to file anything with the police, either in NY or TX, or can I just bring my evidence to an attorney and file the suit from there?

I know that the law leans towards the women in cases like these, and I know cases like this are tough to begin with, but the amount of abuse I have taken I am willing to try. I just am not sure how to first proceed.

Thank you,

James

Re: Spousal Abuse (emotional)

Abuse happens to many persons. An ex-girlfriend of mine once gave me a blow to the face. I was confused and didn't make any response. I was lucky. We broke up before a pattern could establish itself.

Taking steps like filing a criminal complaint can be healing and the law does recognize that purpose. If the actions happened in Texas, then the case must be filed in Texas. If in NY, then file here at any police station. The biggest problem is the time period - if it is too long ago the police will not prosecute. But you can still file a lawsuit for battery in civil court for up to one year. You are welcome to a consultation at no fee at my offices at 42 West 44th St., NY,NY. Re: Spousal Abuse (emotional)

If you are the victim of physical assault, you may contact the police where the assault took place. If the abuse is by theft, you may similarly call the police where the theft took place. If you simply have bad feelings and arguments, get over it and get a life and leave the little girl behind and find a good one next time. Life is too short to focus on negative things. Take the high road.
