Legal Question in Criminal Law in Texas

Theft under 4,000

My daughter took approximately $3400 from her father's (my ex-husband) business when she worked for him. He has told her that he is pressing charges and he has done that. What is the worse that can happen. When he was upset.. he told her to ''just keep it'' but there is no proof that he said that. My dtr realizes the wrong that she has done but her father will not accept that and payments from her unless she can deliver all at once, which she cannot do. Please tell me how that I can help my daughter.

Re: Theft under 4,000

If your daughter is charged, she faces a felony theft, called a "state jail" felony. She faces the potential punishment of a minimum of 180 days (6 months) up to two years in the State Jail (prison) not talking about the county jail. Naturally, she may be eligible for probation and avoid a final conviction, but she needs to get in touch with an experienced criminal defense attorney, not just someone licensed to practice law. From your posting, it appears that your zip code is near my office, so give me a call and set up an appointment so that we may discuss the matter more in depth, the initial consultation is free.
