Legal Question in Criminal Law in Texas

Yesterday, my fiance called dps to see if she was clear to renew her TX driving license and they notified her that she had a warrant in Harris county for Misdemeanor A theft and A assault for an incident dating back oct 2008. So I checked my status and they said I had a warrant for misdemeanor B theft. We had no idea what they were talking about so we did a little investigating. It turned out to be an old friend of ours that we kicked out of our home for smoking crack and not paying rent. On the day of the supposed incident we came over to collect some money after she was paid. She owed us 1000 dollars and gave us 700 dollars then she demanded some of it back to pay off her drug dealer. She was high at the time. We refused to give her back the money told her that we were even and left. She screamed and hollered but we ignored her and drove away. Later that day she came to our home with the drug dealer and he asked us if he get some of the money that she owed him. We refused and 1 year and half later we find out about these stupid charges. The cops never contacted us to hear our side or picked us up. They knew where we lived. We have a witness who was present at the time we entered her home and several witness who saw her and the drug dealer come to our home. We are both college students and work and have 5 kids. Together both of our bonds total 650 dollars close to the amount she gave us, We last heard that she and her crackhead boyfriend who was also present during the incident are homeless and she has 1 foot in the grave. Any advice on what we should do besides hire an attorney because we know that much already. I know this is weak case that should be dismissed at probable cause or arraignment. Please Help!!

You got it right, you need to get a criminal defense lawyer.

In the meantime, do not contact the police or make any statements to anyone.

Good Luck!
