What you are referring to is known as the statute of limitations. This is the period of time between the criminal act and when charges are brought against the alleged actor. It does not apply to the amount of time that the State has to finish a prosecution. The US Constitution does guarantee a right to a speedy trial but the Defendant has to assert that right and any delays due to the Defendant are held against him or her.

You should discuss this matter with your attorney.
