Legal Question in DUI Law in Texas

Possible DWI

My twenty year old son had a wreck Friday night. He had drank about 3 beers, the last one around 8pm. The trooper did the field test on him at the hospital and didn't find him to be drunk, but they took blood and we're waiting on the test results. He was told that because he doesn't drink very often that just one beer will show in the test results. My question is, He has never been in any trouble so is the first DWI a misdimener or a felony?

You need to contact a DWI lawyer ASAP, and get started in the process of defending your son. If the police just file a DWI charge it will be a misdemeanor, but if someone was hurt or died in the accident the charge could easily be filed as a felony whether first or not. That is why you need to get in touch with a DWI attorey, and quit cooperating with the police even if it is just a misdemeanor charge, because your son may be giving them evidence to use against him.
