Legal Question in Family Law in Texas

I have a 6yr old son. His father and I were never married and there has been no contact in 6 years. He is on the birth certificate. My husband is in the Army and has received orders to go to Germany. What rights does his birth father have to keep us from going to Germany? I have to try and get his consent for my sons passport, and I'm worried that he will decide not to sign...I'm not even sure if I'll be able to find him at all. I have a name..that's all I have to go on.

When you apply for the child's passport, include a Form DS-3053. It has to be signed in front of a notary.
