Legal Question in Family Law in Texas

I am trying to change my childs last name through legal zoom.com but the website says i need to have the other parents rights terminated and i don't know where to begin because my child is 10 years old and his biological father has never been around due to the fact he fled the united states because of being involved in a serious crime in the state of California . i find it in the best interest of my son to have his last name changed just need help of how or where to start?

If you want to change the child's last name I recommend that you hire an attorney. The father needs to give permission to change the child's last name. In your case, the man has fled the US and, I assume, you cannot locate him. If you can locate him, then he can sign the paperwork and have it notarized in the country in which he now resides. It's up to the judge if the judge will sign the paperwork to change a minor's name. You need a local attorney to advise you.

If you cannot do it now, then the child can change his name when he turns 18 if he does not have a criminal record and is not evading creditors.
