Legal Question in Family Law in Texas

Child Custody

What is the best way for a grand parent to get custody of the grandchildren? Both parties are in agreement, just need the paperwork and where and when to file.

Re: Child Custody

Suit should be filed in the District Court of the county in which the children reside.

It would be entitled "In The Interest Of (names of children)".

The parents need to sign waivers of service and then a final order granting the grandparents custody should be entered.

I suggest you hire a lawyer to handle the matter because the paperwork is not easily done.

Re: Child Custody

Custody is determined by a court order. You will have to file a petition and get a hearing before the judge. The judge may or may not require a social study (just to make sure you don't have a serious criminal record). If the judge is satisfied that the agreement is in the best interest of the child, he/she will sign an order granting you custody. If you don't know how to do these things, you should get a lawyer. Good Luck.
