child custody

my stepsons mom died, my husband is in jail. there was no custody . her parents are trying to take him. does my husband have the right to make the decision on where his son lives?

Her parents will need to file a SAPCR, and if there was a divorce decree, then there should be some provision regarding custody. If your attorney has an objection, then he needs a lawyer to file for conservatorship. It will be an uphill battle, but there is an outside chance of a favorable resolution.
