Re: Choose

If you are 10 years old or older, you or your father may make a petition to the Court for a change of custody and you may file a Choice of Custody to the Court.

Re: Choose

Under Section 153.002 of the Texas Family Code, the best interest of the child shall always be the primary consideration of the court in determining the issues of conservatorship and possession of and access to the child.

Under section 153.008 states that if the child is 10 years of age or older, the child may, be writing filed with the court, choose the managing conservator, subject to the approval of the court.

In other words, the child can ask but the Court does not have to grant the request.
