if courts are involved with trying to find out who is best for the child, and its over a year old and never finished can the other parent take the child

If there is a pending legal case that is still open, you cannot do anything.

I assume that you have an attorney representing you. Talk to your attorney.

If not, I suggest that you hire one immediately. You need to get this case moving. It appears that it is just "sitting" waiting for someone to file a motion to get in front of the judge or to set this case for trial.

If you "take" the child, I can only assume that the other parent will go to the judge and complain, and you will be "yanked" in front of the judge quicker than I have typed this free answer.

And, I doubt that you will like what the judge does to you! Judges tend not to like people that misbehave while cases are pending in their courts. They like people that are patient and quiet. "Taking" a child will probably not be perceived by the Judge to be a "friendly" act. I don't know what you mean be "taking" a child -- but it sounds possibly bad -- so I can only assume that the Judge won't like it.
