Custody

A friend of mine is needing advice. Her husband and herself are seperated again because of his drug and alcohol abuse. Years ago they had seperated and she was taken to court, she had no money and no attorney. She was afraid and was told if she didn't sign these papers that stated her husband was to have custody that she would be charged with kidnap. Now that they are once again seperated he threatened her and said if she didn't let him take his son for the weekend that he would enforce those papers she signed years ago. She is afraid for her son's safety while in the care of his father. His father is living with a pedifile, a convicted stalker, and he himself has three felonies. What should she do to protect her son from this? Is there any way she can get sole custody with supervised visitations without her son having to live with his father in the process?

I suggest that she get an attorney as soon as possible and file for divorce and seek temporary orders cutting off his visitation. I doubt what ever papers she signed years ago would be of any use to her husband if they are still currently married and what you say about him is true.

Dont delay as it will only benefit him. At the moment, he has as much right to the child as she does. IF cant afford an attorney, try legal services, they may help.
