Legal Question in Family Law in Texas

Divorce

I am curently deployed to iraq. As is my wife. She told me she wants a divorce and that if i dont get someone to show up in court for me that they will grant her the divorce. Is this true? And if this is true is there anyway i can stop that from happening? Also does the state of texas grant legal seperation? And have you ever heard of a lawyer named randall parker out of san antonio texas?

Texas does not have legal separation.

You definately need to hire an attorney to make sure that your rights are protected.

The State of Texas protects military personnel stationed overseas. If done properly, the divorce can be put on hold until you get back to the US.

If the divorce is pending in San Antonio, I suggest that you check www.lawguru.com for a San Antonio Attorney to help you.

I practice law in Houston so I don't know Randall Parker.

You can go to the Texas Bar website to see if there is a licensed attorney in Texas by that name.

Based on what you have written, you need to go talk to your local or area Legal Services Office. An attorney at the Legal Services Office can draft a letter to be submitted to the Court under the Servicemembers Civil Relief Act (SCRA). There is no legal seperation under Texas law. I am an attorney in the Houston area and a Veteran who served nine years in the Navy's JAG Corps. As such, I have not heard of Mr. Parker out of San Antonio. You should request that your Legal Services Office assist you in finding a family law attorney in San Antonio by contacting the Military Law Section of the Texas Bar or searching the Texas Bar's website for a family law attorney.
