Legal Question in Family Law in Texas

I am considering a divorce. I want to regain full custody of my 31/2 year old daughter. My wife has two other children from a previous relationship. My wife has said that she would not fight this request. Can I get legal papers drafted and signed by her voluntarily that can assure me of this outcome if a divorce does occur?

You need to file for divorce so a judge can sign the paperwork and make it binding on everyone. Merely having your wife sign some notarized statement is NOT enough - she can change her mind at any time. A notarized statement will not hold much weight in court.
