failure to return child as agreed

Per standard texas court order the non costodial parent residing over 100 miles away must give written notice of summer visitation plans. He gave notice in writing of pick up date, but no return date, said to call for more info. On the phone he stated when he would return our child and I agreed to this date. Two days after our child was to be returned to me he has changed his mind and decided to keep her for 1 more week. Sent a text message stating his intent. This new return date is within the standard 42 day period. He is leaving Texas to go home and is leaving my child with his mother for this remaining time. Can he do this? Can I legally go pick her up? He is not returning my calls and won't let me speak with my daughter.

Go get your child if you wish and you'll probably succeed if the mother is not hiding child. Or you can get your attorney to raise custody issues in court.
