Legal Question in Family Law in Texas

Paternity Making Divorce Impossible

My wife had a child while we were seperated with another man. I do not want to end up the financially responsible for this child and my ex is very scandalous so its something she would consider. The father lives with her. We have signed the AOP/Denial of paternity. The attorney I hired is stating that even with the AOP being signed the father of the child has to agree to pay child support OR she has to acknowledge he lives with her in order to have the divorce be granted. They won't say they live together .She said she would file child support on on him though not likely because she has not made any moves towards it and tis been months. Is there a way I can just take it to the judge with the evidence requested and pray they grant it anyway? I am totally at loss for what to do. I just want this over with and know that it has to be done without any co-operation from her.
