Legal Question in Family Law in Texas

i am a pregnant single mother and know i cannot care for a second child. the father of the new baby is incarcerated for the next year. i would like to put the baby up for adoption and he isnt willing to give up his parental rights. i dont know if i can financially care for the second child and want him to be well taken care of thus must put him up for adoption. how can i legally do this without the fathers consent without the family worrying about a custody battle with the father in a year when he is released from prison. i am 8 months pregnant and need help with this question asap please. i want this baby to be well taken care of and dont have the means to do so

I don't know what county you live in. I assume that you and the potential adoptive parents live in the same county. The three of you need to talk to an experienced family law attorney. That attorney will be able to give you the advice you need. The situation you describe is not unusual.
